Federal Enforcement Paused, but State Wage Protections Still Apply

U.S. DOL Halts Minimum Wage & Overtime Enforcement
In early July, the Trump Administration announced its intent to restore the companionship exemption for third party employers (such as home care agencies) through a proposed rule which would reverse a 2013 final rule. The 2013 rule denied these employers from claiming the exemption for companionship and live-in domestic service workers. 
Last week, the Department of Labor issued a Field Assistance Bulletin to field staff instructing they suspend enforcement of all provisions from the 2013 final rule. 
However, Massachusetts state law covers home care workers under its wage laws requiring minimum wage and overtime, which should supersede these federal changes. 
The Home Care Association of America has long advocated for reinstatement of the companionship exemption, citing that it would allow home care agencies to provide more continuous care for clients and reduce staffing disruptions for families. But this also puts the industry in a position of advocating against overtime and minimum wage for its direct care workforce.
