Significant Progress Toward Establishing Statewide Standards for Non-Medical Home Care Services

The Home Care Alliance of Massachusetts (HCA) announces that the Massachusetts House of Representatives today passed HCA’s priority legislation to establish licensure for non-medical home care services by a vote of 153–1. This marks the furthest advancement of this initiative in more than 15 years of sustained advocacy by HCA and its members.
Massachusetts remains among a small number of states without a licensure requirement for non-medical home care providers. While many agencies voluntarily pursue accreditation, the absence of a licensure framework leaves gaps in oversight, consumer protection, workforce standards, and accountability. Without baseline requirements, agencies may operate without verified background checks, insurance coverage, compliance with wage and labor laws, or training standards. Establishing licensure will provide clarity, transparency, and basic safeguards for consumers and workers while creating a more level operating field for reputable agencies.
The legislation directs the Executive Office of Health and Human Services to develop a licensure process that includes background screening, training and competency standards, liability and workers’ compensation insurance coverage, service planning expectations, and enforcement mechanisms. Many HCA members already meet or exceed these standards through accreditation and best practice.
HCA extends its appreciation to the members of the HCA Advocacy Committee and to all members who contributed by contacting legislators, supporting PAC efforts, and participating in advocacy at the State House. HCA also acknowledges Chairman Thomas Stanley and Senator Patricia Jehlen for their leadership in advancing a balanced and thoughtful bill.
The bill now moves to the Massachusetts State Senate for further consideration. HCA will continue to actively lead and coordinate advocacy throughout the next phase of the process and will keep members informed of timing and opportunities to engage.
